Terms and conditions

1. Scope

These terms apply to all orders that consumers place in the FOMO online shop at drinkfomo.com. Our contract partner is:

2. Contract

The products in our shop are not a binding offer but an invitation to order. By clicking the button "Buy now" (or similar) on the Stripe checkout page you place a binding order. We confirm receipt by email straight away. The contract is concluded when we send a separate order or shipping confirmation, or ship the goods, at the latest [CONFIRM e.g. 2 working days] after your order.

The contract languages are German and English. We save the contract text and send you the order details by email; you can also save these terms as a PDF or print them.

3. Prices

All prices are in euros and include German VAT ([CONFIRM VAT rate, 7 % or 19 %]). Shipping costs are shown on our shipping and payment page and at checkout before you order.

4. Payment

You pay through our payment provider Stripe. The payment methods available are shown at checkout ([CONFIRM payment methods, e.g. card, Apple Pay, Google Pay, Klarna, PayPal]). Your payment is charged when you order.

5. Delivery

We deliver to [CONFIRM delivery countries, e.g. Germany only]. Delivery times are shown on our shipping and payment page and on the product page.

6. Retention of title

The goods remain our property until paid in full.

7. Right of withdrawal

As a consumer you have a statutory right of withdrawal. Details are in our right of withdrawal notice.

8. Warranty

The statutory warranty rights apply. If a product arrives damaged or not as described, please tell us at ceo@drinkfomo.com so we can put it right quickly. This does not affect your statutory rights.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence we are only liable for breach of essential contractual obligations, limited to the typical, foreseeable damage.

10. Food supplements

Our products are food supplements. Please follow the recommended daily dose and the notes on the pack. Food supplements are not a substitute for a varied, balanced diet and a healthy lifestyle.

11. Subscriptions

[CONFIRM whether subscriptions are offered at launch. If yes: billing cycle, how to pause or cancel (at least monthly, with the online cancellation button under § 312k BGB), and when changes take effect.]

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another EU country, the mandatory consumer protection rules of that country still apply.
